These Terms & Conditions apply to purchases made through www.jontyfranks.co.uk and to products and services supplied by Jonty Franks Art Studio.
Please read these terms before placing an order. By placing an order through this website you agree to these Terms & Conditions.
1. About Jonty Franks Art Studio
Jonty Franks Art Studio is an independent UK art studio selling fine art prints, original artwork and commissioned pieces.

2. Products
I make every effort to describe and display artwork as accurately as possible.
Colours can vary slightly between computer screens, phones and tablets because individual devices display colour differently. There may also be very small variations between images displayed online and a finished print.
Unless clearly stated otherwise, prints are supplied unframed.
Available sizes, paper specifications and other product information are displayed on the relevant product page.
3. Fine art prints
Where stated on the product page, fine art prints are produced using professional giclée printing methods on 310gsm Hahnemühle German Etching fine art paper.
Any limited edition information will be clearly shown on the individual product page.
The purchase of a print or original artwork does not transfer copyright or reproduction rights to the purchaser.
4. Prices
All prices displayed on the website are in pounds sterling.
The price you pay will be the price shown when you place your order.
Any applicable delivery charges will be clearly shown before checkout is completed.
I may change prices at any time. Changes will not affect orders that have already been accepted.
5. Offers and promotional discounts
From time to time Jonty Franks Art Studio may offer promotional prices, discount codes or multi-buy offers.
The individual terms of an offer will be displayed alongside the promotion.
Unless otherwise stated:
discounts cannot be exchanged for cash
discounts cannot be applied retrospectively
only one promotional offer may be used per order
promotions may be withdrawn or changed before an order is placed
Orders already confirmed will not be affected by the withdrawal of a promotion.
6. Placing an order
When you place an order through the website you are making an offer to purchase the products shown in your basket.
You will receive an order confirmation by email.
An order is accepted once payment has been successfully processed and the order has been confirmed.
Please check the information in your confirmation carefully and contact me as soon as possible if anything is incorrect.
If for any reason I cannot fulfil an order I will contact you and refund any payment received for the unavailable item.
7. Payment
Payment is processed securely through the payment services provided through the website.
I do not personally receive or store your complete debit or credit card details.
Payment providers process payment information in accordance with their own terms and privacy policies.
8. UK delivery
UK mainland delivery is free on print orders where this is stated on the website.
Orders are normally sent using Royal Mail or another suitable delivery service.
Please allow approximately 3–5 working days for UK delivery once your order is ready for dispatch.
This is an estimated delivery time rather than a guaranteed delivery date.
Unless a different delivery period has been agreed with you, goods will be delivered within the period required by applicable UK consumer law.
I am not responsible for delays caused by circumstances reasonably outside my control although I will always try to help resolve a delivery problem.
9. International delivery
International delivery may be available.
If international delivery is not available directly through checkout, please contact me before placing your order so I can provide a delivery quotation.
Customers outside the UK are responsible for any customs charges, import duties or local taxes that may apply in the destination country.
Jonty Franks Art Studio is not responsible for delays caused by customs authorities.
10. Your right to cancel a standard online print order
If you purchase a standard non-personalised print online, you normally have the legal right to change your mind.
You must tell me that you wish to cancel within 14 days of receiving your order.
You then have a further 14 days to return the goods after telling me that you wish to cancel.
You do not need to give a reason for cancelling.

11. Returning a standard print
If you cancel an eligible order because you have changed your mind:
the artwork should be securely repackaged
you are responsible for the direct cost of returning it
you should take reasonable care of the artwork while it is in your possession
please obtain proof of postage when returning the item
You may inspect the artwork in the same way that you reasonably could in a shop.
If the value of the item has been reduced because it has been handled beyond what is reasonably necessary to establish its nature and characteristics, an appropriate deduction may be made from the refund where permitted by law.
12. Refunds following cancellation
For an eligible cancellation I will refund the amount you paid for the returned goods.
Where you paid a standard delivery charge, this will also be refunded where required by law.
If you chose a more expensive delivery service than the standard delivery option, I am not required to refund the additional amount above the standard delivery cost.
Refunds will be made using the original payment method unless otherwise agreed.
Refunds will be processed within the period required by UK consumer law once the returned goods have been received.
13. Commissioned and personalised artwork
The standard change-of-mind cancellation rights described above do not normally apply to goods that are genuinely made to your individual specification or clearly personalised for you.
This may include:
original commissioned artwork
artwork created around a particular subject requested by you
personalised artwork
substantially customised versions of an existing artwork
unusual sizes or specifications made specifically for you where these make the item bespoke
Before I begin a commission we will normally agree the main details including:
the subject
dimensions
orientation
colour palette
style or creative direction
price
expected timescale
printing requirements where applicable
framing requirements where applicable
I will make it clear when an order is being treated as a bespoke or personalised commission.
Your statutory rights still apply if commissioned artwork is faulty, damaged or materially different from what was agreed.
14. Commission deposits and payments
A deposit or advance payment may be required before commissioned work begins.
The amount and payment schedule will be agreed with you before the commission starts.
Any terms relating to cancellation after work has started will be explained before payment is taken.
Any amount retained following cancellation will be reasonable and will reflect work already undertaken and costs or losses actually incurred where permitted by law.
Nothing in this section removes any rights you have under applicable consumer law.
15. Changes to a commission
I want commissioned artwork to feel personal and right for you.
Reasonable changes can be discussed during the agreed development process.
If you request substantial changes after the original brief has been agreed, additional work may be chargeable.
Any additional charge will be discussed and agreed with you before that additional work is carried out.
16. Customising an existing print
Selected artworks may be available in different sizes, orientations, colours or other variations.
A standard option offered to all customers is not necessarily a personalised product.
Where an existing artwork is substantially altered or made specifically to your individual requirements, I will make it clear before accepting the order that it is being supplied as a bespoke or personalised product.
17. Damaged deliveries
Please inspect your order when it arrives.
If artwork arrives damaged please contact me as soon as reasonably possible at:

Depending on the circumstances I will arrange an appropriate replacement, repair or refund.
Please keep damaged packaging until I confirm whether it is required for a delivery claim.
18. Faulty or incorrect goods
You have legal rights if goods are:
faulty
damaged
not as described
not of satisfactory quality
not fit for their intended purpose
If you believe you have received faulty or incorrect goods please contact me.
Nothing in these Terms & Conditions limits or removes your statutory consumer rights.
19. Framing
Unless otherwise stated, prints are sold unframed.
Framing or other presentation options may sometimes be available by request.
Where bespoke framing is ordered, the specification, price and estimated completion time will be agreed before the order is confirmed.
20. Intellectual property and copyright
All original artwork, illustrations, photographs, designs, branding, text and other creative content displayed on this website remain protected by copyright and other intellectual property rights.
Unless otherwise stated, copyright remains with Jonty Franks.
Buying a print, original artwork or commissioned artwork gives you ownership of the physical item.
It does not give you copyright or reproduction rights.
Without prior written permission you must not:
reproduce the artwork
make copies of it
scan or digitally reproduce it
commercially print it
sell reproductions
use it as branding or advertising
use it on merchandise
distribute digital copies
otherwise exploit the artwork commercially
Please contact me if you are interested in licensing artwork for commercial use.
21. Website images
Images on this website are provided to show the artwork and products available.
Website photographs, product photographs and artwork images must not be downloaded, copied or reused for commercial purposes without permission.
Sharing a link to the website or to a product page is welcome.
22. Gift purchases
You may purchase artwork as a gift for another person.
The purchaser remains responsible for providing the correct delivery information.
Please check the address carefully before completing the order.
23. Incorrect delivery information
You are responsible for providing an accurate and complete delivery address.
If you notice an error after placing an order please contact me immediately.
If an order has already been dispatched I may not be able to change the delivery address.
If an item is returned because an incorrect or incomplete address was provided, additional delivery charges may apply before it is sent again.
24. Events outside my control
I will not be responsible for a delay or failure to perform an obligation where this is caused by circumstances reasonably outside my control.
Examples may include:
postal or courier disruption
severe weather
transport disruption
fire or flood
failure of essential third party services
widespread internet or technology failures
other exceptional events outside my reasonable control
If a significant delay occurs I will contact you where reasonably possible.
Your statutory rights are not affected.
25. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
In particular, nothing in these terms excludes responsibility for:
death or personal injury caused by negligence
fraud or fraudulent misrepresentation
faulty goods where liability cannot legally be excluded
goods that are not as described
any other liability that cannot legally be excluded
These terms do not affect your statutory consumer rights.
26. Privacy
Personal information is handled in accordance with the Jonty Franks Art Studio Privacy Policy.
The Privacy Policy explains what information is collected, why it is used and how it is protected.
27. Cookies
Information about cookies and similar technologies used on this website can be found in the Jonty Franks Art Studio Cookie Policy.
Visitors can also manage optional cookies using the Cookie Settings provided on the website.
28. Complaints
If you are unhappy with an order or with the service you have received, please contact me first so I have an opportunity to resolve the problem.

I may update these Terms & Conditions from time to time to reflect changes to the website, products, services or applicable law.
The latest version will always be available on this website.
The terms applying to an individual purchase will be those in force when that order was placed.
30. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these terms prevents a consumer from relying on any mandatory legal protections available to them.
